Lindsay Lohan avoids jail time, for now



Troubled actress Lindsay Lohan's luck has continued.

About 5 minutes late and looking a bit sleepy, Lohan appeared in the court of Judge Stephanie Sautner on Wednesday where she avoided jail time, but didn't avoid a few quips from Sautner, who has sentenced Lohan before.

During the hearing, Lohan's new attorney, Mark Heller, addressed "drama" surrounding Lohan's apparent decision to come to court despite saying she as too sick to appear in recent days.

Heller, who now fills in for Lohan's longtime attorney Shawn Holley, whom she fired, explained Lohan decided to appear despite the upper respiratory infection to "show respect to the court."

"Is that like a cold," Judge Sautner quipped. Heller said it was more like the flu.

"No it's not, "Judge Sautner shot back. "The flu is the flu."

Lohan is charged with lying to police, reckless driving and obstructing officers from performing their duties. The charges stem from an incident in which Lohan's sports car was crashed into a dump truck in June. Lohan allegedly told police she wasn't driving at the time.

In March of 2011, Judge Saunter released Lohan from probation with a strict warning.

"You need to live your life in a more mature way, stop the nightclubbing and focus on your work," Sautner told Lohan at the time.

Lohan's pretrial hearing is scheduled for March 1, but Lohan is not required to attend.
