Cannabis coalition suing city over marijuana moratorium

BELLINGHAM, Wash. – A medical marijuana coalition says Bellingham’s moratorium on collective gardens is illegal.

Steve Sarich with Seattle-based Cannabis Action Coalition says they are suing the City of Bellingham for its ‘emergency’ ordinance imposing zoning restrictions on medical marijuana outlets.

Sarich says they’re already in the middle of an expensive legal battle with the City of Kent over a similar moratorium on collective gardens.

The Bellingham City Council voted unanimously to pass the moratorium, which could be in place for up to one year.

The lawsuit filed this month argues that Bellingham does not have any power or right under state law to zone or otherwise regulate collective gardens.

The city has 20 days to respond to the lawsuit.
