Wash. Supreme Court upholds breach of trust ruling against BIAW

WASHINGTON STATE, – The Washington Supreme Court has handed a victory to several businesses that challenged the Building Industry Association of Washington for skimming money off of their trust funds.

Knoll Lowney is one of the lawyers representing RE Sources, A-1 Builders and six other small businesses in the case.

He says the BIAW took money from the trust funds set up for workers compensation insurance reimbursements from the state.

The BIAW had appealed to the state Supreme Court, but the high court upheld the lower court’s decision.

The case now goes back to the trial court in Thurston County, where the court will decide how much money the BIAW has to pay back.
