Judge Jeffrey Ramsdell says the prosecution erred when it considered the strength of their evidence when they chose to seek the death penalty against Michele Anderson and her ex-boyfriend, Joseph McEnroe.
Ramsdell says prosecutors should only have considered whether mitigating circumstances existed when making their decision to seek a penalty of death for the defendants.
McEnroe and Anderson are each charged with six counts of aggravated murder in the deaths of the victims.
