Local Protesters’ Defense Nixed



Bellingham, Wash -- The local coal protesters known as the "Bellingham Twelve" say they are being denied their constitutional right to present their defense in court.

Commissioner Peter Smiley has ruled that the group cannot use climate change, coal or freedom of speech as legal defenses.

One of the defendants, Bob Burr, says the ruling has left them with no other way to defend themselves in court.
 
The twelve are being prosecuted for blocking a railroad crossing in Bellingham during a protest against coal trains in December 2011.

Burr says if they can't present their defense, the jury will never know the motivation behind what they did.

He says the commissioner agreed that climate change was real, but told the group that they haven't exhausted all other possibilities for a defense.
